Knakl Cloud — Acceptable Use Policy

This Acceptable Use Policy (the “AUP”) describes conduct that is prohibited on Knakl Cloud LLC (“Knakl”) infrastructure. It is incorporated into and forms part of the Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.

Violating this AUP is a material breach of the Terms of Service and may result in suspension or termination of your Account under Section 8.2 of the Terms. This AUP applies to you, to anyone using your Account, and to your End Users. You are responsible for their conduct as if it were your own.

1. Illegal and Harmful Activity

 

You may not use the Services to engage in, promote, facilitate, or conceal any activity that is illegal under United States federal law, Florida state law, or the law of any jurisdiction applicable to you or your End Users. This includes:

  • fraud, phishing, identity theft, or financial scams;

  • distribution of child sexual abuse material (CSAM), which we report to the National Center for Missing & Exploited Children as required by 18 U.S.C. § 2258A;

  • human trafficking, exploitation, or the sale of persons;

  • unlawful sale or distribution of controlled substances, weapons, or counterfeit goods;

  • money laundering, sanctions evasion, or unlicensed money transmission;

  • content that is defamatory, harassing, or that threatens or incites violence against any person or group;

  • infringement of copyright, trademark, patent, trade secret, publicity, or other intellectual property or proprietary rights;

  • unauthorized collection, sale, or disclosure of personal data.

2. Network and Security Abuse

 

You may not use the Services to compromise, disrupt, or gain unauthorized access to any system, network, or account — whether Knakl’s, another customer’s, or a third party’s. Prohibited activity includes:

Attacks and disruption - denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks, amplification or reflection attacks; - deliberate consumption of shared resources in a manner that degrades service for other customers; - traffic flooding, packet manipulation, or IP or DNS spoofing.

Intrusion and reconnaissance - unauthorized port scanning, vulnerability scanning, penetration testing, or probing of systems you do not own or have written authorization to test; - password cracking, credential stuffing, brute-force attacks, or session hijacking; - accessing any account, server, network, or data without authorization.

Malicious software and infrastructure - distributing, hosting, or controlling malware, ransomware, spyware, keyloggers, rootkits, or viruses; - operating botnet command-and-control (C2) infrastructure; - hosting phishing pages, credential-harvesting sites, or spoofed websites impersonating another organization; - operating malware droppers, exploit kits, or infrastructure for distributing stolen data.

Security research exception. Legitimate security research and authorized penetration testing are permitted only where you have documented written authorization from the system owner. Notify us at support@knakl.com before conducting testing that may generate traffic patterns resembling an attack. Testing against Knakl’s own infrastructure requires our prior written permission.

 

 

 

3. Email, Messaging, and Spam

 

You may not use the Services to send unsolicited bulk email or messages (“spam”). Specifically, you may not:

  • send commercial email in violation of the CAN-SPAM Act, CASL, GDPR, or other applicable law;

  • send email to purchased, harvested, scraped, or rented address lists;

  • falsify headers, sender identity, return paths, or routing information;

  • operate open mail relays or open proxies;

  • fail to honor unsubscribe requests promptly;

  • send messages that generate excessive bounce rates or spam complaints.

Outbound mail. Outbound SMTP on port 25 is restricted by default on new Accounts. To request that this restriction be lifted, contact support@knakl.com and describe your sending practices, list-acquisition method, and expected volume. We may decline or revoke this at our discretion.

If your Account generates spam complaints, blocklist entries, or abuse reports, we may suspend outbound mail immediately and without notice.

4. Content Restrictions

 

You may not use the Services to host, store, or distribute:

  • CSAM or any sexually explicit content involving minors (zero tolerance — immediate termination and law enforcement referral);

  • non-consensual intimate imagery;

  • content promoting terrorism, violent extremism, or genocide, or that recruits for or finances such activity;

  • content that infringes intellectual property rights (see Section 10 of the Terms of Service for our DMCA process);

  • pirated software, cracked applications, license-key generators, or media distributed without authorization. 

We do not prohibit lawful adult content between consenting adults, but such content must comply with all applicable law, including 18 U.S.C. § 2257 recordkeeping requirements where applicable. Notify us at support@knakl.com if you intend to host adult content at scale.

 

 

 

5. Resource Use and Abuse of Shared Infrastructure

 

The Services operate on shared infrastructure. You may not:

  • exceed the resource limits of your plan in a way that degrades service for other customers;

  • circumvent, disable, or manipulate resource metering, quotas, throttling, or billing systems;

  • run processes designed primarily to consume CPU, memory, disk I/O, or bandwidth without a legitimate application purpose;

  • resell or sublicense the Services in violation of restrictions published for your plan;

  • create multiple Accounts to evade limits, suspensions, resource quotas, or promotional credit restrictions.

Cryptocurrency mining is prohibited unless expressly permitted in writing for your plan. This includes mining, hash generation, and proof-of-work computation performed for cryptocurrency, whether for yourself or on behalf of others.

6. Artificial Intelligence and Machine-Learning Workloads

 

AI and ML workloads are permitted on compatible Services, subject to Sections 7.4 and 7.5 of the Terms of Service. In addition, you may not use the Services to:

  • generate CSAM or non-consensual intimate imagery of real people;

  • create deceptive synthetic media (deepfakes) intended to defraud, defame, impersonate, or interfere with elections;

  • operate systems designed to conduct unlawful surveillance, social scoring, or biometric identification in violation of applicable law;

  • generate content at scale for spam, disinformation campaigns, or coordinated inauthentic behavior;

  • train on datasets you do not have the legal right to use.

Knakl provides infrastructure only. You remain solely responsible for the models, data, prompts, outputs, and legal compliance of your AI workloads.

 

 

 

7. Reporting Abuse

 

Report suspected violations to support@knakl.com with the subject line “Abuse Report”. Please include:

  • the IP address, hostname, or URL involved;

  • a description of the activity;

  • relevant logs or headers with timestamps and time zone;

  • your contact information

We review reports promptly. We may not be able to share the outcome of an investigation with you due to customer privacy obligations.

 

 

 

8. Enforcement

 

What we may do. Depending on severity, we may: request that you remediate the issue within a stated period; throttle or filter traffic; suspend affected resources or the entire Account; terminate the Account; preserve and disclose relevant information to law enforcement; and report unlawful content as required by law.

Notice. We will usually attempt to contact you before suspending an Account and give you an opportunity to fix the problem. We may act immediately and without notice where the activity involves CSAM, an active attack on a third party, a serious security incident, a legal obligation, or a risk of imminent harm to Knakl’s infrastructure or other customers.

No refunds. Suspension or termination for AUP violations does not entitle you to a refund, and any unpaid fees remain due (Terms of Service, Section 3.7).

Appeals. If you believe your Account was suspended in error, contact support@knakl.com with an explanation and any supporting evidence. We will review the matter in good faith, but the decision to reinstate an Account is at our sole discretion.

Data. Suspension or termination may result in loss of Customer Content. Your backup obligations under Section 6 of the Terms of Service apply regardless of the reason for suspension.

9. Changes to This Policy

 

We may update this AUP as legal requirements, security threats, and abuse patterns evolve. We will post the updated AUP and revise the “Last Updated” date. Material changes may also be notified by email or through your Account. Continued use of the Services after the effective date constitutes acceptance.
